It has been increasing to use airplane as civilization develop. Also, it is true that airplane accident has been increasing in proportion to the use of airplane. The more society develops, the more airplanes are used for transportation and special object including putting out a fire. According to the increase of airplanes the risk of plane accidents are increasing. Thus, the need of Aviation Insurance is increasing.
However, there is no law enforcement about Aviation Insurance. Therefore we need proper consideration of such Aviation Insurance Law enforcement. Among them, it is time to consider about make up for the damage caused to the third party, In many cases, aviation accident victims are damaged by unpredictable cause, In Korea, there is no such law as the third party liability insurance. So, environmental disputes sue is the main Environmental Disputes Coordination to resolve the problem. This sort of accident is not a part of environmental disputes but a part of the third party liability insurance. So, the damage caused should be dealt with the third party liability insurance properly. To do this, we have to divide the Aviation Law which is now a part of marine law.
The reason for this is the difference between Aviation Insurance System and Marine Insurance System. We should make an independent category of aviation insurance to protect the rights of people involved.
