As the recent technological developments have increased the economic usage of radio spectrum, the UK radio spectrum management system isgoing through rapid change. The essence of regulatory transformation is tocomplement traditional licensing system with market mechanism to provide the spectrum users with incentives to choose more efficient way of use. Administrative incentive pricing, licensing through auction, spectrum trading, and spectrum liberalisation are those incentive mechanism adopted in the Wireless Telegraphy Act 2006.
From the details of such market mechanisms the following observations are specially worth mentioning. First, the restructuring existing license system with market mechanism. Spectrum auction and spectrum trading are not replacing the licensing system but inserted as a part of it. For a transfer of spectrum to be legally effective, a transferor has to surrender the license and a new license has to be issued to a transferee. By preserving the basic structure of licensing system, the Act keeps the Ofcom empowered to control spectrum allocation effectively.
Second, the discretionary power of the regulatory agency to take care of public interest. The Act provides the detailed guidance of spectrum trading, but, at the same time, it gives the Ofcom to decide which license class is subject to trading and its concrete procedure. It seems to enable the Ofcom to reconcile two conflicting values, public interest in spectrum management and economic efficiency through market approaches.
Third, the method to concretize the contents of Spectrum Usage Rights. The contents of “rights”which is subject to trading are not necessarily same as the rights under the Civil Law. It is important to formulate a proper concept of “right”in the light of public interest and regulatory purposes of spectrum management.
