In February 2003, International Chamber of Commerce's long-awaited publication "International Standard Banking Practice for the Examination of Documents under Documentary Credits(ISBP)" was published after the approval by the full commission at its meeting in Rome in October 31, 2002. The ISBP has been written to help businesses which use Uniform Customs and Practice for Documentary Credits, 1993 Revision(UCP 500) as a practical complement to the UCP 500.
In this paper, I examined the provisions of the ISBP concerning transport documents. The results of the analysis using the transport documents provisions of the ISBP and related cases are as follows. Firstly, because some kinds of transport documents contained in the UCP were excluded in the ISBP, it is necessary to complement to stipulate for those transport documents. Secondly, some transport documents provisions of the ISBP are in conflict with the related provisions of the UCP, so the UCP should revise on the basis of the ISBP. Thirdly, some transport documents provisions of the ISBP impose more responsibility for examination of transport documents. Finally, ICC should bear in mind to make opinions of the Banking Commission or DOCDEX decisions in the lines of the ISBP.
