According to the rules of the UCP 500, the documents requested by Irrevocable Credit must be complied with the terms conditions of the Credit and the documents required by stipulation or provision of Credit must be in accordance with themselves.
However, there is actually not difference for the meaning between the "in compliance with" and the "in accordance with" and provided that the two appearances between the stipulated in the Credit and the documents presented to the bank don't basically have any defect, then regards them as "compliance with".
The Korean Supreme Court has sentenced in many cases that the mere examination of the documents without giving of value does not constitute a negotiation and the payment by the negotiating bank before the maturity under the Deferred Payment Credit would not constitute the negotiation.
Therefore banks must examine all documents in the Credit to ascertain whether or not they appear on the face to be in compliance with the terms and conditions of the Credit. Compliance of the stipulated documents on their face with the terms condition of the Credit, shall be determined by bank themselves under the international standard banking practice on the basis of the documents alone whether or not they appear on the face to be compliance with. Documents which appear on their face to be inconsistent with one another will be considered as not appearing on the face to be in compliance with the terms and conditions of the Credit. If Credit contains conditions without stating the document to be presented in compliance therewith, banks will deem such conditions as not stated and will disregard them. The Issuing bank shall have a reasonable time, not to exceed seven baning days following the day of receipt of the documents, to examine the documents and determine whether to take up or refuse the documents and to inform the party from which it received the documents accordingly.
