Electronic certification/authentification has been discussed for some time but has yet to command much attention from business to policy makers. This paper addresses directions of constructing the institutional and legal infrastructures of the electronic certification/authentification for the activation of the international transactions through internet. Securing the accountability of the certification authority and the efficient applicability of the certifying function to the real transactions is prerequisite for the purpose of the certification system to be obtained. To meet this prerequisite, the electronic signature and certification technology should be supported by certain institutional and legal infrastructures as well as other cryptograph measures.
Considering such prerequisite, this paper suggests to introduce the discretionary license system of the certification authority, the global arrangements for the reasonable regulation on the electronic signature/cryptograph to enhance the stability and efficiency in international electronic trade, and the limited liability system and efficient measures to meet the potential liability of the certification authority.
