In this article, an attempt was made to establish the rules of interpretation of warranties in marine insurance contract. A warranty may be defined briefly as a written term of the contract of insurance in which the assured warrants, owing to the force of express words or through the operation of law, either that certain statements of fact are accurate, or that he will take the due performance of an obligation specified therein. The result of a breach of the warranty is to enable the insurer to avoid the policy and repudiate all liability from the date of breach, notwithstanding that the content of the warranty may not have caused a loss in respect of a claim is brought. The essential characteristics of a warranty are briefly these: (a) it must be a term of the contract (b) the matter warranted need not be material to the risk. (c) it must be exactly complied with (d) a breach entitles the insurer to repudiate the contract notwithstanding that the loss has no connection with the breach or that the breach has been remedied before the time loss. In conclusion, even though the strict compliance in general insurance contract other than marine insurance has been relaxed in order to protect the assured, it has long been well-established law in marine insurance since Lord Mansfield's day that (1) with small exceptions, a warranty is independent of all questions of materiality: (a) the fact warranted may be of no relevance to the risk (b) a loss need not be occasioned by the breach of warranty in order that the breach may protect the insurer. (2) There must be strict and exact compliance with the obligation or statement which warranted.
