International Chamber of Commerce published Incoterms 2010 defining 11 trade terms from EXW to DDP. DDP is the price terms that seller deliver the goods to buyer when the goods are arrived at named place of destination after import customs clearance.
LDP is different form 11 trade terms of Incoterms 2010 and is not defined at Revised American Foreign Trade Definitions, 1990 also. Following the definition of International Trade Administration of the U.S. Department of Commerce, Landed Duty Paid (LDP) Value is the sum of the CIF value plus calculated duties. LDP is mainly applied the export of fiber product to U.S. market from China, Hong Kong, Taiwan and South Korea.
In the view of SCM (Supply Chain Management), VMI (Vendor Managed Inventory) is an efficient logistics mechanism and LDP/DDP terms are proposed the appropriate contract terms to VMI.
This study is focused on the definition and on the reason of application of LDP. It intends to get some practical implication of the usage of LDP also. As LDP is not clearly defined about the responsibilities of seller and buyer, and exporters to U.S. market may have bear the risk of their product until the final order from the real buyer not the formal buyer who make import declaration to U.S. Customs. While U.S. Customs doubt the change of the country of origin through illegal transportation of Chinese fiber product via Hong Kong, Macao, South Korea and is enforcing screening of these products. Some Exporters of fiber product in South Korea are suggested to do not transport their products illegally and to manage their MID (Manufacturer's Identification) number to prevent from strict inspection of U.S. Customs.
