The international human rights movement is of relatively recent origin. International human rights law has developed, with the establishment of necessary institutions for its implementation and enforcement. As the movement is rooted in the world community’s response to the excesses inflicted upon humanity by the Nazi regimes during the Second World War, the founders of the United Nations ensured that the Charter would reflect the close relationship between international peace and security and international human rights. Thus, Article 1 of the Charter lists among the purposes of the U.N. “to achieve international cooperation in promoting and encouraging respect for human rights and for fundamental freedoms for all without distinction as to race, sex, language, or religion.”
In addition, the U.N. General Assembly created the International Covenant on Civil and Political Rights and the International Covenant on Economic, Social and Cultural Rights to promote and protect human rights and to provide effective remedies. The U.N. promotes both the universal ratification and the implementation of the major human rights treaties and ensures the enforcement of universally recognized human rights norms.
This article examines the protection of international human rights with specific reference to the core United Nations human rights treaties and system. While acknowledging some of the weaknesses of the UN human rights treaty system, this article nonetheless views this system as a vehicle for strengthening the globally accepted notion of the universality of human rights and as a viable framework for the domestic implementation of those rights. As domestic courts expand their use of treaties to interpret domestic law, what is needed is a fully articulated theory regarding judicial use of human rights treaties. Judges and scholars must develop an evaluative framework between the domestic and international legal regimes. Finally, observing international human rights have been led initiatives to improve human rights.
