There has been a legal dogma that membership should be equal to farmer in case of agricultural cooperative membership in Korea. But we need to develop an alternative solution to match changes in social and economic needs, entitling farmer to general membership, and ex-farmer to limited membership. Both memberships are genuine memberships. In order to prevent non-farmers from governing agricultural cooperatives, it is needed to introduce some restrictions on limited membership, for example, public interest, or voting right, invoking French case. In this way, agricultural coop. could be evolved from industry cooperative into community cooperative.
This study also focuses on “the autonomy of articles of association”, another form of private autonomy in field of organization or groups. Under this rule, individual cooperative can regulate its own membership. Korean law does not yet accept this rule while either Japanese or German law has accepted this rule. This autonomy rule is necessary for cooperatives to develop into the direction of community solidarity.
