1. 로스쿨 교수들의 고뇌와 그 해결책먼저 로스쿨 교수들은 2009년 4월에 통과된 변호사시험법에 의하여 2012년 봄에 로스쿨 1기 졸업생에게 치러질 변호사시험내용을 생각하면서 무엇을 어떻게 가르칠 것인가를 고뇌한다. 미국 로스쿨에서와 같이 변호사시험은 전혀 신경 쓰지 않고 나름대로의 가르치고 싶은 것을 마음껏 가르칠 수 있어야 국제법률시장 개방시대에 국제경쟁력있는 로스쿨로 발전할 수 있으리라고 본다. 이렇게 본다면 우리의 경우 변호사시험을 보지 않고 미국의 Wisconsin과 New Hampshire 주(州)에서와 같이 로스쿨 졸업증으로 변호사자격을 주는 것(Diploma Privilege)이 바람직하다고 본다. 왜냐하면 우리 로스쿨은 입학정원을 미국이나 일본과는 달리 2000명으로 한정하고 있고 또한 교육에 있어서 엄격한 상대평가를 하고 있기 때문이다(Ⅱ.4. 참조).2. 일반 법과대학 교수들의 고뇌와 그 해결책다음으로 일반 법과대학 교수들은 각 대학교에서의 법과대학 존폐문제에 깊은 고뇌에 빠져 있다. 여기서 우선 생각할 수 있는 것이 현행 로스쿨법은 비법학사만 로스쿨 신입생의1/3 이상으로 의무화하고 있지만, 법학사도 로스쿨 신입생의 1/3 이상으로 하는 것을 의무화해서, 그것을 기반으로 로스쿨 교육기간을 법학사는 2년 비법학사는 3년으로 하는 법 개정을 하는 것이다. 이것은 법학사 비법학사를 똑같이 3년 교육하는 현재의 불합리를 일본식으로 개선해서 로스쿨 교육의 질을 높힐 수 있을 뿐만 아니라, 일반 법과대학에게도 그 졸업생을 로스쿨에 보낼 수 있는 기회를 주는 것이기 때문에 로스쿨과 연계되어 일반 법과대학의 존재이유와 학문발전에도 크게 기여할 수 있으리라고 본다(Ⅲ. 참조).3. 국제법률시장 개방시대에 법학교수에게 변호사자격 부여해야 한다.FTA 등으로 우리나라 법률시장 개방화·국제화에 엄청난 파장을 가져올 것에 대비하여 법학교수에게 변호사자격을 주는 것은 우리 법률시장의 전문화·국제화 경쟁력을 높이고 법 실무와 연계되어 로스쿨과 법과대학 교육발전에 큰 기여를 하게 될 것이다(Ⅳ. 참조).
While the Act on the Establishment and Operation of Law School(hereinafter Law School Act) was enacted in Jul. 2007 and the Law School was established only in 25 Universities on the nationwide in Mar. 2009, the Professors of Law School and the other Law Dept. has been deeply agonized in their own way on the Subject for the Normalization of Legal Education in Korea. What is the Solution Method?1. The Agony of Law School Professors and the Solution MethodAbove all, Law School Professors are agonized on the teaching of what and how, especially much stuffy when they think about the contents of Bar Examination by Bar Examination Act enacted in April 2009 which the first student of Law School will take at the spring in 2012. Notwithstanding the examination subjects become more than the current Legal Profession Examination, does the Law School Professor have to teach as in an educational institution to enhance the ratio of successful applicants ? As though they hope to teach like that, it is not only easy but also unfit to the Article 2 (Ideals of Education) in Law School Act “possessing knowledge and capabilities that enable professional and efficient settlement of complicated legal disputes”If Law School Professors could teach fully the contents they want neglecting Bar Examination as in the American Law School, it seems that our Law School can develop to be internationally highly competitive in the period of opening international lawyer market. In the perspective, it seems that in our country‘Diploma Privilege’is very desirable which gives lawyer qualification to the Law School Graduate without Bar Examination as in the states of Wisconsin and New Hampshire, because number of new students of the Law School in Korea for a year are defined to 2000 unlike U.S.A. or Japan and in education relative estimation system is strictly conducted, and it is thought that Bar Examination can not fully verify lawyer qualification. Notwithstanding, if the Bar Examination is inevitably necessary, it seems that only the type of examination which deals with case record is enough(cf.Ⅱ.4).2. The Agony of Law Dept. Professors and the Solution MethodNext Law Dept. Professors are deeply agonized on the question of maintenance or abolition of Law Dept. in their university. Especially the professors of 16 Law Dept. that applied to go Law School in fail at the last occasion have been deeply concerned about the future course including entry into Law School. Here in the first place the revision of Law School Act is suggested that the education period of Law School is reduced to 2 years for the bachelor of laws like Japan style, on the condition that the bachelor of laws also is obliged above 1/3 of the Law School freshman, although in the current Act only none of Bachelor of Laws is obliged above 1/3 of the Law School freshman. This revision means not only enhancing the quality of Law School education by improving the current unrationality that teaches 3 years samely for the bachelor of laws and none of bachelor of laws, but also contributing remarkably to the reason for being and learning development of Law Dept. connected with the Law School, for it gives the opportunity to the fallen 16 Law Dept. of which graduates can go to the Law School (cf. Ⅲ).3. In the period of opening international lawyer market, the Qualification of Lawyer must be given to the Professor of LawAlthough the FTA between Korea and EU is currently ratified by the National Assembly and comes into effect at Jul. 1. 2011, and the FTA between Korea and U. S. A. is also near in time, it is conclusively evident that these FTAs will make tremendous effect to the open policy and internalization of our lawyer market. That is to say, when the worldwide law firms of U. S. A. and England etc. make largely
inroads into our country, for the sake of making preparation for this phenomenon, it contributes largely to the development of education of the Law School and Law Dept. conneted with the practices of lawyer profession that the Qualification of Lawyer must be given to the Professor of Law. And it will also enhance the competitiveness of professionalization and internalization in our lawyer market (cf.Ⅳ).
