Because drone industry is an industry that is directly connected to ICT technology, its ripple effect is huge without any distinction between public or private due to its development. Therefore, the government can designate or expand new special liberalization and pilot business zones where licensing conditions for the implementation of drone industries will be eased by enacting the "Act on Promotion of the Utilization of drones" in 2019. Financial support for the drone industry will also be available for legal basis and operation and support of a new drone traffic management system. Although it is desirable that drone concept is partially introduced into drone law, it still borrows much of the concept from aviation safety law and others. Another problem is the form of legislation that relies on enforcement rules, not laws. It does not help establish the independence of the drone law. Under law, it is highly likely that 12 kilograms of drone accidents will be covered under civil law, responsibility for manufacturing products, or insurance policies that are arbitrarily purchased by individuals without any special regulations. Considering its acceleration in case of a crash, it is urgent to take measures to deal with it, as the infringement on an unspecified third party is not small. Pilot certification and safety certification and flight approval exemptions are also too heavy for germany when the weight is 250 grams. The actualization of education also needs to be carried out. Although the information communication law should be applied first because the data processing system uses telecommunication facilities, the drone law provides compliance regulations with the Personal Information Protection Act and the Location Information Act It is a problem to limit the processing of countless personal information to "collection and transmission." An urgent revision should be made to "collection and transmission, etc." Although it is a problem due to lack of normality, it is also necessary to introduce regulations that have similar contents to Japan's "Guidelines for Compliance with the Disclosure of Drones Films on the Internet." ‘Common European rules on drones’, have been published to ensure drone operations across Europe are safe and secure. The rules will amongst others help to protect the safety and the privacy of EU citizens while enabling the free circulation of drones and a level playing field within the European Union.

드론산업은 빅 데이터 및 ICT 기술과 직접적으로 연결이 예정된 산업이라 그 발전에 따른 공공 혹은 민간의 구분이 없이 파급효과는 크다. 따라서 정부는 2019년 “드론활용의 촉진 및 기반조성에 관한 법률”을 제정하여 드론산업의 실행을 위한 인허가 조건이 완화되는 특별자유화구역 및 시범사업구역을 새로이 지정하거나 확대할 수가 있게 됐다. 드론산업에 대한 재정적 지원의 법적 근거마련 및 새로운 드론교통관리시스템 운영과 지원도 가능하게 됐다. 드론산업의 활성화를 위한 중요한 대책들이다. 드론개념이 부분적으로 드론법에 들어온 것은 바람직하지만 여전히 개념의 많은 부분을 「항공안전법」 등에서 차용하고 있는 것은 문제다. 법령이 아닌 시행규칙에 의존하는 입법형식도 문제다. 드론법의 독자성 확립에 도움이 되지를 않는다. 제한된 활용방향이 옳지만 안전성 및 보안성과 적절한 피해배상이 동시에 고려될 필요가 있다. 현행법에서는 드론사고 시 비영리목적의 12킬로그램의 경우 별다른 특별법의 규정이 없이 민법상의 불법행위나 제조물책임 혹은 개인의 임의로 가입한 보험처리 등을 통해 피해자에 대한 피해구제가 이뤄지고 있다. 신속성 및 실질적인 피해구제로는 부족하다. 사고 시 그 가속도를 고려한다면 불특정 혹은 다수인 제3자에 대한 침해가 작지만은 않기에 이에 대한 실질적인 대책마련이 필요하다. 무게 및 위험도를 고려한 제3자책임보험가입 및 공제회 활용을 적극적으로 고려해야 한다. 조종자 증명 및 안전성 인증과 비행승인 면제대상도 그 중량도 독일은 250그램인 경우와 비교하면 12킬로그램이면 너무 위험도가 크다. 하향조정의 필요성이 크다. 드론조종자 및 개발자에 대한 교육훈련의 실질화도 이뤄질 필요가 있다. 또 드론을 통한 정보주체에 대한 개인정보의 저장 및 전송의 처리도 전기통신설비를 이용한 정보처리이기에 정보통신망법이 우선 적용이 되어야 함에도 불구하고 드론법에서는 「개인정보보호법」 및 「위치정보의 보호 및 이용에 관한 법률」을 중심으로 준용규정을 두고 있다. 드론을 통한 저장 및 삭제 등 무수한 개인정보의 처리에서도 ‘수집 및 전송’으로 한정하고 있는 것은 더 큰 문제다. ‘수집 및 전송 등 처리’로 시급하게 개정이 되어야 한다. 드론을 통한 수집된 촬영물에 대한 적절한 통제대책이 있어야 한다. 규범력이 없어 문제지만 일본의 「드론촬영물의 인터넷 공개 시 준수 가이드라인」과 유사한 내용을 가진 규정도입도 고려할 필요가 있다. 「범죄수익은닉의 규제 및 처벌 등에 관한 법률」의 개정을 통한 적용을 통해 범죄수익에 대한 기소전 몰수를 포함하여 해당 수익을 적극적으로 환수하도록 할 필요도 있다. 또 네트워크를 통한 불법물의 매개의 차단을 위해 전기통신사업법상이나 정보통신망법상의 사업자의 역할증대를 법적으로 보장하기 위해 불법유해정보를 열거식으로 규정하고 있는 전기통신사업법상 혹은 정보통신망법상 드론을 통한 불법물도 포함시켜 적절한 관리를 하게 할 필요도 있다.
