The local governments system, which was revived through the constitutional amendment in 1987, has undergone many changes amid many difficulties and limitations. Now, local government is at the crossroads of going beyond the beginning of the system to decentralization. We are moving beyond the beginning of the system to a time to consider decentralization. In order for the local government system to develop into a more independent and autonomous partnership of the state, practical guarantees of local government must be made. In the case of other countries implementing local government, broad powers are explicitly guaranteed by the constitution to local governments, and from the point of view of functional decentralization, the state and local governments are premised on a partnership of cooperation or a partnership of division of labor. In Germany, due to the new control model resulting from the reform of the government management system, the US-style government operation is being Germanized. As a result, past discussions about the local autonomy system have become nothing more than experiences of the past. The Constitution Amendment Bill proposed in 2018 and the Local Government Act, which was fully amended in 2021, are positive changes in that they tried to solve the tasks for decentralization. However, it is possible to criticize that the paradigm remains in the existing system in the process of transition to decentralization. However, they are still hesitant to solve the problems of the 20th century. The local autonomy system is institutional security, and the essence of local autonomy is resident autonomy. It is necessary to change the perception of legal reservations that local governments can determine important matters through agreements such as agreements and contracts in addition to laws. With the change of the new paradigm of the local government system, the realization of a new local government system that breaks away from the existing discussion about local government can be expected only when the center of the local government system changes from local governments to residents.
