The local governments system, which was revived through the constitutional amendment in 1987, has undergone many changes amid many difficulties and limitations. Now, local government is at the crossroads of going beyond the beginning of the system to decentralization. We are moving beyond the beginning of the system to a time to consider decentralization. In order for the local government system to develop into a more independent and autonomous partnership of the state, practical guarantees of local government must be made. In the case of other countries implementing local government, broad powers are explicitly guaranteed by the constitution to local governments, and from the point of view of functional decentralization, the state and local governments are premised on a partnership of cooperation or a partnership of division of labor. In Germany, due to the new control model resulting from the reform of the government management system, the US-style government operation is being Germanized. As a result, past discussions about the local autonomy system have become nothing more than experiences of the past. The Constitution Amendment Bill proposed in 2018 and the Local Government Act, which was fully amended in 2021, are positive changes in that they tried to solve the tasks for decentralization. However, it is possible to criticize that the paradigm remains in the existing system in the process of transition to decentralization. However, they are still hesitant to solve the problems of the 20th century. The local autonomy system is institutional security, and the essence of local autonomy is resident autonomy. It is necessary to change the perception of legal reservations that local governments can determine important matters through agreements such as agreements and contracts in addition to laws. With the change of the new paradigm of the local government system, the realization of a new local government system that breaks away from the existing discussion about local government can be expected only when the center of the local government system changes from local governments to residents.

1987년 헌법개정을 통해 부활한 지방자치제도는 많은 어려움과 한계 속에서 많은 변화를 이루어 왔다. 이제 지방자치는 제도의 시작을 넘어 지방분권으로 나아가는 기로에 놓여 있다. 제도의 시작을 넘어 지방분권을 고려하는 시기로 전환하고 있다. 지방자치제도가 보다 자주적이고 자율적인 국가의 동반자 관계로 발전하기 위해서는 지방자치의 실질적 보장이 이루어져야 할 것이다. 지방자치를 실시하고 있는 다른 국가들의 경우 지방자치단체에 폭넓은 권한을 헌법에서 명시적으로 보장하고 기능적 분권의 관점에서 국가와 지방자치단체는 협력의 파트너 내지 분업의 동반관계를 전제로 하고 있다. 독일은 행정관리체계의 개혁으로 인한 신제어모델으로 인해 미국식 정부운영 방식의 독일화가 이루어지고 있다. 이로 인해 지방자치제도에 대한 과거의 논의는 지난 시대의 경험에 지나지 않게 되었다. 2018년에 발의되었던 헌법개정안과 2021년 전부개정된 지방자치법은 지방분권을 위한 과제들을 해결하고자 하였다는 점에서 긍정적인 변화이다. 하지만 지방분권으로 페러다임이 전환하는 과정에서 기존의 체계에 머물러 있다는 비판이 가능하 전환 속에서 의 지방자치관련 개헌내용들은 어찌 보면 그동안의 숙원과제를 해결하려 한 것이었다고 긍정적으로 평가할 수도 있다. 하지만 아직 20세기적 과제해결에도 주저하고 있는 모습을 보이고 있다. 지방자치제도는 제도보장이며 지방자치의 본질은 주민자치라는 전환이 필요하다. 지방자치단체가 법률 외에 협약, 계약 등의 협정으로 그 중요사항을 정할 수 있다는 법률유보에 대한 인식의 변화가 필요하다. 지방자치제도의 새로운 패러다임의 변화에 따라 지방자치제도의 중심을 지방자치단체에서 주민으로 변화하여야 기존의 지방자치에 대한 논의를 탈피한 새로운 지방자치제도의 실현을 기대할 수 있을 것이다.
