The following study examines the current state of inactive domestic sports agent system and attempts to examine its practical problems to have a better understanding and awareness of the sports agent system in order to vitalize and systemize the sports agent system as an indispensable part of the modern sports industry.
In order for the study to achieve its purpose, special law such as civil law, attorney’s law, certified licensing law, previous research papers, precedent cases, case studies and other data were collected and comparatively analyzed. An evaluative study approach on a combination of literature sources were chosen to be reviewed.
The results are that even though implementation of sports agent system in the domestic sports industry is an urgent problem, a variety of realistic and institutional hurdles prevent it from being vitalized in the industry. Some of the realistic problems that limit the activity of domestic sports agents are the narrowness of the current domestic professional sports industry, the reluctance to accept representation for professional sports players through the presence and intervention of sports agents, lack of mutual trust between players and agents, lack of an active union for players, weak legal base for agents activities, and the general lack of insincerity by agents; additionally, limitations on representatives from autonomous agreements in sports, article 109 of attorney’s law, and laws regarding employment security were identified to be some of the legal hurdles to the problem.
