This thesis aims to describe the political reality surrounding border management today and to reveal the notion of sovereignty that widely spread and repeatedly reproduced in border management administration and courts. The sovereignty used in border management does not appear to be completely consistent with the ‘sovereignty’ we generally understand. The sovereignty of a sovereign state is based on the principle of supreme power internally and equality externally, but these characteristics are not expressed as they are. In immigration matters, it is the internal sovereignty that justify to call for the yield of the rule of law and impose broad discretion on legislation and administration. However, sovereignty itself cannot be practically exercised, sovereignty alone is difficult to explain the structure and technology in which the influence of border management spreads to individuals. Also, the principle of equal sovereignty under international law appears to be partially revised and adjusted in the face of the reality of border management. The reality revealed through border management technologies and treaties for smart borders used in many countries today demonstrate that the principle of equality of sovereignty is not expressed as it is. In light of the fact that sovereignty is not the only logic that works in border management, and even that is largely modified and operated, it is necessary to reflect on the immigration administration that takes the retreat of the rule of law.

이 논문은 오늘날 국경관리를 둘러싼 정치적 현실을 살펴보면서, 출입국관리 행정과 법원에서 반복적으로 원용되고 있는 주권의 절대성, 그리고 국제법상 주권평등의 원칙을 재고찰하는 것을 목적으로 한다. 이 논문에서 전달하고자 하는 바는 다음과 같다. 국경관리 주권은 누구를 국경 안으로 들여올지를 결정하는 것에서 그 임무를 마치고, 법치주의 후퇴를 전면적으로 정당화할 수 있는 절대성을 부여하는 힘이라는 점에 대해서는 재고가 필요하다. 국제법적 주권평등의 원칙 역시 오늘날에는 다양한 국경관리 행정 및 인권보호 요청과 같은 규범적 기준에 의해 상당 부분 수정되어 나타난다. 국경관리에 사용되는 주권은 우리가 일반적으로 이해하는 ‘주권’과 완전히 일치하지 않는 것으로 보인다. 주권국가의 주권은 내부적으로는 최고권력, 외부적으로는 평등의 원칙에 기초하고 있으나 이러한 특성은 국경관리에 그대로 표현되지 않는다. 이민행정에서 법치주의의 양보를 요구하고, 입법과 행정에 광범위한 재량권을 부과하는 것을 정당화하는 것은 국내주권과 밀접하게 연관되어 있다. 그러나 주권은 실질적으로 행사될 수 있는 것이 아니며, 주권만으로는 국경관리 영향력이 개인에게 확산되는 구조와 기술을 설명하기 어렵다. 아울러, 국경관리의 현실에서 국제법상 주권평등의 원칙은 부분적으로 수정되고 조정되어 나타난다. 오늘날 많은 국가에서 사용되는 국경관리 기술과 스마트 국경설립을 위한 조약은 주권평등의 원칙이 현실에서 그대로 표현되지 않음을 보여준다. 이상을 배경으로 주권적 논리를 앞세워 출입국관리 행정에서 법치주의 양보를 요구할 때에도 더욱 많은 고민이 필요해 보인다.
