In this paper, I tried to introduce the book 'The Heumheum sinseo(欽欽新書)’ by way of thinking with legal cases.
The method of this paper is to compare legal argument and legal reasoning of the book with modern Korean counterparts. In the Heumheum sinseo law and ethics was not clearly separated but systematically intermingled. However, in modern Korean legal reasoning law and ethics should not be intermingled.
The Heumheum sinseo was a work of outstanding originality compared to the casebooks compiled in China in pre modern imperial China.
First, the Heumheum sinseo was a very analytical work, so it was easy for readers (local magistrates, local governors, and judicial officials of the central government) to find the issues they wanted. Therefore, it seems that manuscripts summarizing the Heumheum sinseo were often made and widely read by acting and prospective officials in Joseon.
Second, the Heumheum sinseo could serve as a binding casebook for officials.
Third, the Heumheum sinseo should be analyzed by the perspective from the social history of knowledge.
Scholars should use Jeong Yak-yong's writings as a means to analyze the era and society he lived in.
