An automobile insurance event is an accident arising out of the ownership, use or maintenance of the insured automobile. In the typical automobile liability policy issued in Korea, the insurer agrees "to pay all sums which the insured shall become legally obligated to pay as damages because of bodily injury or destruction of property... arising out of the ownership, use or maintenance of the insured automobile. The automobile insurer pays the damages because of an accident... arising out of the ownership, use or maintenance of the insured automobile in Art. 726-2 of Commercial Law which was amended and came into effect as of Dec. 31, 1991. This is a study on the concept of 'ownership, use, maintenance' above.
Depending upon the interpretation the concept of 'ownership, use, maintenance' can be stretched in an insured or a sufferer favor unlimitedly because the insured automobile is always under the ownership, use or maintenance of the insured during the period of insurance. The scope of 'the ownership, use or maintenance' is wider than that of 'the operation' of Art. 2 & its Paragraph 2nd of the exiting Automobile Liability Insurance Law in Korea and Japan, and almost the same concept as the ownership, use or maintenance of automobile insurance policy in America where it is interpreted more widely than in Korea and Japan. But the scope of those can not be extended unlimitedly. 'Arising out of' is only important in interpreting the scope of the 'ownership' and 'maintenance' because the insured automobile is always under the ownership or maintenance of the insured. And the 'use' should not be extended beyond' use of a vehicle as such'.
