Noises and vibrations generated from military air bases, etc. have become social issues since 1990's, which have been the target of civil petitions by many neighboring residents in connection with the fundamental rights as guaranteed by the Constitution. This requires the military authorities to take appropriate measures for them. Most of all, it is of urgent necessity to arrange laws and regulations concerned to solve and mediate disputes over them.
Actually, residents living around the military air bases, etc. are sustaining serious damages from noises of the military aircraft, etc. and accordingly, the residents and local governments concerned are requiring the military authorities to take necessary measures for the prevention of noises and compensate for the damages, even to relocate the military air bases or the residents themselves. Not only that, the lack of legal provisions governing the prevention of noises and compensation for damages is causing many serious problems in actuality.
In consideration of these conditions, this study seeks to research into and analyze legal issues on the prevention of noises in question and the compensation of damages from such noises and thereby to present concrete legislative measures therefor. The purpose of this study is ultimately to present possible measures to solve civil petitions against the military aircraft noises in the future and utilize the military air bases, etc. efficiently.
