The primary objective of this study is to elucidate the universal nature of human rights and its trade-offs thesis; and to examine current characteristics of democracy in South Korea in relation to the ‘candle light demonstration’ which was proceeded from May 2008 to August 2008.
First of all, on the basis of Jack Donnelly’s human rights theory on universalism and relativism, this study is exploring which discourse is more applicable to the human rights situation in the modern society. In view of the Korean history, authoritarian governments in particular mounted a challenge to universal human rights and democracy. Moreover, the logic of ‘Korean style democracy’ has been used by Korean repressive status to support the trade-off proposition: that a certain degree of authoritarianism is necessary to make a state stable, in terms of national security, maintenance of social stability and order, and social welfare including spectacular economic growth, and that such dimensions will ultimately facilitate the promotion of human rights.
However, in recent decades the history of human rights in South Korea offered no promise or proof that human rights will be extended to citizens under repressive social situation with economic development. Authoritarian leaders have justified their failure to protect human rights not only as a sacrifice necessary to ensure the success of their economic development strategy, but also as essential for the maintenance of law and order.
Basing itself on an understanding of human rights perspectives and on practices in modern Korean history, this study concludes that various restrictions on human rights cannot be justified in the name of national security, maintenance of law and order, and economic growth; and that human rights, a critical factor of desirable democracy, cannot be pushed aside until political and economic situation ard consolidated. In the same context, a country's democratic policies should not the political interests of abusive governments, but basic human rights.
