These days, industrialization and urbanization caused our city to have various problem like that is a sudden rise of land price and a shortage of housing, a traffic jam and an environmental disruption and so on. For trying to find a solution to these problem, we are to examine the possibility reception of legislation in relation to acquisition land being public as the means regulation for utilization land and the types urban planning in French. In this paper, have a look into the general features of the urban planning system in French and be regarded the facilitation and regulation for utilization land promotive public welfare and diverse legislation of restriction of the ownership. These studies will improve our capacity of enjoyment of the basic human rights and they will be also the starting point for facilitating a balanced land development in all over the country. In addition they'll contribute greatly to the efficient development of our urban planning system and the law for utilization land.
1. The broad sense of urban planning in French including in an agricultural area and an urban area
2. The Urban Planning and Zoning Acts in French have changeovered in order of urban planning of control police→conservation→enterprise. As the result, French took an active hand and administration joins hands with unofficial. The major facts has changed and developed after the 5th Republic. That is in the following examples. extension of official expropriation, exponsion of preemption system, P.L.D. and C.O.S.
3. The basic land system in 30th December, 1967 included in land utilization planning is the kernel of my paper. It comprised of S.D. and P.O.S. As it were, when government improve public facilities, they have the prior claim to a personal right. Take examples, Z.U.P, ZAC., ZAD..
4. In January, 2000, our country enacted the law for a revised community plans to prevent the confusion by a dual enactment between the law for the community plans and the architectural laws and to make a local cooperative plan, a great - sphere plan. And then we laid a foundation for a spatial plan establishment through a common use for a French region planning. What is more, we need to form the plan for using land into an all-out plan for a city a county.
