The purpose of this paper is to examine the specifics of ICSID Arbitration and to help the our investors or government for reference in their investment contracts. This author analyzed and divided the characteristic features, comparing to other arbitration system, into three parts.
First, the scope of the ICSID Convention is very limited; the investment disputes must be a legal; the parties must have agreed to submit their disputes to ICSID; the dispute must be between a Contracting State or its subdivisions and a foreign investor from another Contracting State; it must arise directly out of an investment.
Second, the relevant ICSID provisions contain a number of special rules regarding the composition of the tribunal, the proceedings, the tribunal's powers and the power to grant interim relief as well as applicable law. And the provisions of the ICSID Convention are complemented by Regulations and Rules adopted by the Administrative Council of the Center Regulations and Rules comprise Administrative and Financial Regulations, including Institution Rules and Arbitration Rules.
Third, the most distinguished is about the annulment proceeding. Under all other arbitration system, the challenge of an award is controlled by the state courts, in general those of the place of arbitration.
Finally, the ICSID awards have a special regime for recognition and enforcement in Article 54 of the Convention. All Contracting States are required to recognize the award and enforce its pecuniary obligations as if it were a final judgement of the court of the state.
