While the nature and scope of the pre-contractual duty of utmost good faith are fairly clear, the principle of post-formation duty has not been established clearly in English insurance contract law. The main objective of this article is, therefore, to analyse the scope and duration of the duty including the remedies for breach of the duty from the point of recent English case law. In these respects, the position of English case law is not so clear that I would like to permit limited effects to the analysis in this article. The results of this article are as following.
First, although the duty of utmost good faith is, traditionally terminated prior to the conclusion of contract, it has been so clear recently that the duty has the post-formation dimension because there is no such express provision in s.17 of MIA 1906 and s.17 is so wide enough to analogy the post-formation dimension. Secondly, the assured is under a post-formation duty in cases where the parties to a contract consent to the variation, extension or renewal of the contract, and the remedy for breach of the duty is prospective termination instead of retrospective avoidance. Thirdly, Mance LJ, in the Ageon case, concluded provisionally that there was no relation between the fraudulent claim and the post-contractual duty, although it was thought that there was a close relation between two concepts, and the fraudulent claim should be, therefore, treated by the public policy rule of common law. In this respect, it is somewhat doubtful what ist the exact consequence of the breach of fraudulent claim, but the clear fact is that the rule gives much flexibility to the remedy for the breach.
