New Environment led by Convergence of broadcasting and telecommunication stimulates the introduction of new media and the convergence of devices and media. In this reason, the interpretation of licensing agreements on the copyrights is getting more important German Copyright Law provides the general principle on the e interpretation of copyright licensing agreements, which is a noteworthy precedent by the point that it expressly stipulated in the law the principle of limited interpretation of licensing coverage.
The benefit of copyright holder is reduced by the direct infringement however, there are also considerable amount of cases damaging copyright holders by the legal use of the copyrighted works in the reproduction and distribution.
In this regard, the Licensing Agreement should expressly define the rights granted and assignment of rights in writing in order to avoid the disputes regarding the interpretation on license based on new media. In the event of the ambiguity, agreements should be interpreted favorably to copyright holders and the copyright holder reserves the right unless otherwise expressively provided.
