Recently, insurance crimes assume an aspect of organization, intelligence and wide conspiracy. One of the difference of recent insurance crimes is participation of organized crime group. They committed insurance crime in cooperation with employee of insurance company, so the disclosure of insurance crime becomes more difficult.
Insurance crime is regulated by §347 of criminal law, as fraud crime. But there is no definition about insurance crime in this provision, so it is too difficult to control insurance crime. The insurance crime made ill use of insurance that could protect social community from future risks, so that it attempted to get monetary benefits to weaken risk guarantee levels. Therefore, the illegality of insurance crime. is thought to be different from that of fraud crime of criminal law.
What makes matters worse is that the sentencing of court is too generous comparing with the illegality and seriousness of insurance crime.
I suggest a bill for amending the Act on the Aggravated Punishment, etc. of Specific Economic Crimes. The aim of this bill is to control new trend of insurance crime. This bill has new provisions to tackle organized insurance crime or habitual insurance crime. The new provision classifies complicity by degree of participation.
The new provision serves to spread cognition that insurance crime is serious and severe crime. The proper sentencing through degree of crime participation will leads to increase general prevention effect.
