This paper has examined whether there are any significant differences in terms of illegality or exemptions for privacy invasion between old media and new media environments. Other than the proactive attitude of the general public to control their own information, not many substantial differences have been observed in terms of illegality judgment and legal exemptions. Regardless of the changing nature of communication technologies, basic principles for the judgment that were used in the old media environment seem to work well in the new media environment. This paper also concludes that any type of intrusion or surveillance conducted by the government with high technologies is not tolerable, unless it is allowed by law and has a compelling interest for it. Even for that situation, the government is required to use a minimum level of surveillance or intrusion, in order to achieve the state objective for public interest. Privacy invasion in private sectors, such as corporation’s e-mail monitoring or surveilla ance cameras in the workplace also needs to be reexamined cautiously.
Recent court decisions in favor of employers’ monitoring right in the workplace needs to be under scrutiny to assess if those decisions harmonize each part’s right to a reasonable degree. Legislative efforts need to be further made to help people control their own information both in public and private sectors, in terms of information collection, access, correction, and its use, etc. It is strongly recommended to establish an authoritative institution with expertise and ethics, to effectively protect right to privacy both in public and private sectors. Especially, a claim to redemption for invasion needs to be strengthened in a new legislation. Inter governmental effort to protect personal information in a database is also essential to secure the right to privacy in the digital era. As all transactions on the Internet are constantly and effortlessly surveyed, recorded, and manipulated, various legal and non legal means to curtail those activities need to be developed systematically by the government, the inudustry, and citizen groups.
