While revealing natural right as origin of modern human right is necessarily related with political sovereignty, this thesis try to say that essence of the right does not appear only as individual human’s subjective ask, but is ‘politically’ asked, in other words, asked ‘as a way of a foundation of imagining another constitutions.’
This article argues that modern process of forming human right should be along with relation of stat and society which necessarily formed the‘polity’ and accordingly, development of modern human right has been formed along with the contents and scope, relation of individual civil liberties, social right and political right. Through the argument, reflective understanding is made that civil liberties, social right, political right as voting right should not be understood as a process of individual extension, or a parallel and continual extension of those rights.
Therefore modern civil liberties, social right, political right should be asked not as a question of what kind of political community would be oriented but, with wider scope of relation, as a question of restructuring of the relation of individuals, societies and state. The orientation of movement of extension of human right should not be activation of individual right or existing political form, but extension of ‘the individual’, ‘the social’, and ‘the political’. That extension of the right is the political in which the struggle to the political power that has enjoyed privilege of specificate the right and structure new polity in which the way of individual actions are related and formed.
