This paper offers a political explanation of modern money, by analyzing how modern money has been historically originated and constructed by political and legal motivations. Modern money has been constructed to extend property rights, and this extension is made when the modern banking system cleverly mixes two disparate rights property rights and contractual rights to enjoy the benefits and reduce the costs of both sides. This mixture implies that modern money would not originate without the Roman legal tradition that had invented a peculiar conception of property and establishes property law independent of contract law. This paper identifies that political motivations have been crucial in mixing the two disparate rights, and this identification leads to understand modern money as a political phenomenon. The political understanding of modern money will contribute to overcoming the myopia of economics that had failed both to anticipate the global financial crisis of 2008 and to suggest a fundamental solution to it.

본 논문의 목적은 자본주의 화폐가 어떤 미묘한 정치적·법적 조합 과정을 거쳐서 창조되는 지 분석함으로써 화폐에 대한 정치학적 설명을 하는 데 있다. 이 설명을 통해 자본주의 화폐를 정치적 현상으로 이해할 수 있도록 할 것이다. 특히 자본주의 화폐는 특정 법체제가 있었기 때문에 가능하다는 걸 보일 것이다. 이 특정 법체제는 고대 로마법에 기반해서 서구에서 발전하였는데, 그 특징은 소유법이 계약법과는 별도의 법으로 독립해 있다는 것이다. 즉, 로마법 전통의 서구의 독특한 소유권 제도 없이는 자본주의 화폐도 불가능했을 것이다. 자본주의 화폐는 기본적으로 소유권을 확장하고 강화하기 위해 고안되었으며, 그 소유권을 확장하는 방법은 소유권과 계약권을 교묘히 섞어서 둘 다의 이점은 취하여 책임은 최소화하고 권한은 확대하는 것이다. 이러한 소유권과 계약권의 융합은 자본주의 이전 시대에는 불법이었으나, 17세기 후반 영국에서 합법적 제도로 정착된다. 본 논문은 이 정착이 어떤 법적·정치적인 역관계와 동기 속에서 이루어지는 분석할 것이다.
이러한 정치학적 이해는 경제학의 고유 영역으로 여겨져 왔던 것에 대한 도전이며, 글로벌 금융위기 이후 근본적인 해결책을 제시하는 데 실패한 경제학의 근시안을 극복하려는 시도이다. 또한 본 논문은 정치학적 설명을 전개했던 포스트케인즈 학파의 화폐론의 한계를 적절하게 비판하고 극복함으로써, 화폐에 대한 정치학적 설명의 지평을 넓히려고 노력할 것이다. 이 노력을 통해, 화폐의 본질적인 위험성이 무엇인지를 부각시키고, 이러한 위험성을 제거하기 위해 어떤 정치적·법적인 개혁이 가능한 지를 연구할 수 있는 단초를 마련하고자 한다.
