Report Errors
This paper mainly focused on analyzing the “Environment and Trade” chapter under Korea-China FTA, which became effective in 2015. This chapter has nine Articles including a duty to increase the level of environmental protection, bilateral cooperation to enhance the environmental protection, establishing the environmental committee and etc. It is a very significant chapter for both parties since China had never had a separate environmental chapter having the substantive rights and obligations of the parties before. However, this chapter lacks the procedural provisions which may ensure fairness and transparency. In order to have an institutional framework to ensure both parties are in following this chapter, the roles of the Committee on Environment and Trade should have been clearly defined. Adoption of effective dispute settlement system will be needed in order to settle the disputes arising from rights and obligations under environment chapter. In addition, even though this chapter has an environmental impact assessment, but it is not clear when it had to be done. Since an ex-ante environmental impact assessment does help to draw an effective trade and environmental polices, this ex-ante assessment should be considered.
