Recently the using of internet is increasing in cyber space, for example anonymity of cyber space, the freedom of expression for the width of the premise of increased personal freedom, but over the limits of privacy and infringement of privacy, defamation, insults, harassment and cyber stalking, and the dysfunctional. The two types of emerging cyber crime in our society are raised. The one is stalking, the traditional crime such as cyber stalking, cyber-fraud, cyber pornography etc. The other is the act, such as hacking or computer viruses. The purpose of this research to continue growing, and the cyber-stalking a crime in order to respond effectively to the proposed legislation has already several times, including the stalking law to find the best way. We study the scope of the stalking laws in the past, proposed legislation to Congress (not) from the currently pending legislation and the law setting the terms and provisions of the cyber-stalking. Thematic approach to the proposed legislation, including stalking law and criminal in law cyber-stalking-related provisions and regulations mentioned in the punishment of a comprehensive review is thoroughly reviewed. Even though the stalking legislation proposed in the past, was discarded stalking legislation can not be discarded making a law have shown, it is the nature and value of the academic strengths and weaknesses based on existing laws (not) to compare and all of the special law related to stalking and other nation's stalking law especially in Germany. Also we should study the current criminal law practices to accommodate to compare Germany and find new direction.
