In Japan, as social polarization has increased, poverty and social disparities have become issues for society since the 1990s. Japan’s social security law and social security policies have been aimed at countering such a situation. This paper seeks to introduce the response of Japan’s social security law to social polarization. It is thought that the primary driver of social polarization in Japan has been changes in employment practices. Therefore, by introducing Japan’s social security law with Japan’s current labor laws and employment policies, this study seeks to offer a comprehensive understanding of the problem. This paper initially examines the background behind the recently emergent view of the necessity to examine both social security and labor law. It will then clarify what the recent debates surrounding the social security and labor laws from a theoretical perspective have been. Finally, it will focus on the issue of irregular employment for a social security law that takes social polarization into account. Adherents of an argument that has developed recently regarding Japan’s labor law and social security law, which perceives employment and social security, or the labor law and social security law, together within a comprehensive field of vision, through tracing their distinct historical developments, are once again becoming conscious of the connections and mutual relations between labor law and social security law. While this shows, theoretically, the idea of its connections to social inclusion and that the applicability of the right to work has expanded beyond the notions of “worker” and “work” in the labor law, it is, on the other hand, also connected to how to understand the right to life and the social security law, which focuses on work but also relates to social activities with no pay.
