Both Rawls" "equalitarian liberalism" and Sandel"s insistence on "minimizing disproportionate opportunity in capitalistic economy by consolidating fair procedures" presuppose more or less democratic liberalism which permits civil discussions and decisions. And theory of justice on the basis of civil society is also be found in Plato and Aristotle who present themselves at the dawn of Western philosophy.
Theory of justice of these Western philosophers, both modern and ancient, however, could hardly be applied to the present Korean Society which has remnants of feudalistic tradition, Japanese colonial domination, American military regime, despotism of Seongman Lee"s government and the so called "Revitalizing Reforms" of Jeonghee Park"s dictatorship successively. Predicaments of Korean society refer not only to the evils of capitalism, but to the feudalistic authoritarianism which let people submit blindly to the state authority, and the abuse of public power committed by the police, military, judiciary, and the administrative bureaucrats. Various kinds of violence, committed by state power, both covertly and overtly, have obstructed civil initiatives.
In order to surmount infringement of civil rights by the state power and consolidate infra-structure of civil initiatives and in Korea, inequality of arms" between the state and civil society, which let the state hold power over the citizens, has to be revised. A fair democratic society can only be achieved through clearing off feudal authoritarianism as well as bureaucratism of the state, a part of whose power rearranged and returned to the hands of citizens who could themselves supplement vacancy of state administration, and supervise potentially negative operation of state power.
Above all, authoritative conventions of the Judiciary resulting in arbitrary judgement, a legacy of colonial as well as dictatorial domination, have to be abrogated on the one hand, and "Citizens" Initiative for Legislation’ and "Call by Citizens", which let the citizens go in company with, and keep watch an eye on, the state power, have to be established on the other. "Citizens" Initiative for Legislation,’ is to protect legislation not to be deviated from original purport by private interest of assembly members or political parties. And "Call by People" is to let citizens, as a sovereign of state, inspect the abuse of state power.
