The aim of the European Union constitution is to be the “rule book” of the enlarged European Union, with the aim of simplifying and unifying European Union rules, in particular with regard to the ability of an enlarged union to act coherently and swiftly. However, the “Non”‐vote of France in May 2005 and the “Nee”‐vote of the Netherlands in June 2005 called into question the acceptance of the EU Constitution by the member states. The new rules laid down by the Treaty of Lisbon largely follow the aim of the aborted constitutions´ approach to simplify rules in face of an ever‐larger union. This paper compares the institutional design of the European Commission with the French planning bureaucracy. The comparison clarifies some of the underlying problems of the crisis of the EU and allows to draw some conclusions concerning the reform of existing institutions of the EU.
