The Japanese government establishes “the law on activation of the scientific technology․innovation creating” and has enforced the regulation for obligating the government support so that the universities promote the industry academic cooperation, and it is supported by publicly announcing Industry-Academic Convergence Guidance Model Program on June 2020.
By the policy support in such a Japanese government, universities startup and manage the venture company to industrialize patent rights and know-how owned by universities, and also on the basis of the patent technology derived by the common study of the university and the company, the venture startup is positively induced. Venture companies which start-up by using patent rights owned by universities or patent applications obtained by commonly studying with universities are 2,566 companies in 219 universities as of January 1, 2020.
As shown through legislations and policy, statics relating to the industry academic cooperation and the venture startup in Japan, it is tried to possibly industrialize results by the common study of the industry academic cooperation, and in Korea it is needed to induce the venture startup in the university referring to such a policy and a management in Japan.
First the provisional non-exclusive licence system and the provisional non-exclusive licence system in the Japanese Patent Law will be analysis in depth and reflected to the Korean Patent Law, and through the system it is need to promote the industrialization by transferring the technology even before patent applications would be patented. It is needed to positively utilize the Cross-Appointment System in that excellent talents in universities or companies having an outstanding point of view enter into employment contract between plural universities or private enterprises respectively and can do all of both works. The cooperation of universities and private enterprises are very important because the polar Japanese policy corresponding to the trade dispute in the Japanese government, and it is determined to need the strong support policy of the government which can positively support the technological development and patent strategy, industrialization of the patent invention via such an industry academic cooperation.
