New technologies are constantly emerging, as well as new application for those technologies. Modern societies are frequently confronted with various associated risks delivered by these developments. On January 1. 2019, Korea government had implemented Act on Safety Management of Consumer Chemicals Products and Biocides(hereinafter ‘Chemical Products Safety Act’) to safeguard consumers against it. However, it is not facile to regulate such risk in the perspective of legal policy; traditionally, regulation is so far considered to be control in legal practice; It is true that, in the context of economics, it is questionable whether banning or controling on industries that deal with chemical substances and chemical products for the purpose of safety management would be beneficial. thus, to set up a center pillar is important in order that management is performed properly and stably.
This article’s aim is to provide some suggestions for the improvement safety management of living chemical products from legal perspective. We stress at the outset that the definition of ‘regulation’ is reoriented. more specifically, this article proceeds on the assumption that regulation functions as ‘steer’, diverging from the control. In order to achieve it, role of risk communication should be underlined in entire regulation mechanism. simultaneously, there is absolutely no doubt that risk assessment and management of consumer chemical products is performed strictly.
On the basis of such assumption, we suggest opinions to improve safety management of consumer chemical products. ① Chemical Products Safety Act is meant to is the framework in regulating risk of chemical products. however, the current rules are too deficient to take a core sufficiently. thereby, it should take some measures to secure a status of framework act; the scope of application should be more clear not to be double application by other Act. ② it should be more strength penal provisions, especially recalling illegal products and imposing penalty surcharge to ensure the effectiveness of administrative implementations. ③ risk communication should be strengthened, through maximizing application of information network-establishment provision by Chemical Products Safety Act.
