This study aims to suggest policy implications for the reorganization of spatial planning systems regarding planning autonomy in the era of decentralized planning powers. The research findings are as follows. First, German planning autonomy is based on the integration of the Constitution, as well as local autonomy and spatial planning systems. Second, in the German spatial planning system, non-statutory planning tools not only play a complementary role for statutory planning tools, but also in the discretionary planning activities of state and local governments. Third, as a minimum administrative unit, gemeinde has the freedom to form a spatial structure and autonomy to operate various non-statutory planning tools under the comprehensively delegated autonomous legislative power. Fourth, the use of non-statutory planning tools is considered by local planning culture rather than administrative bureaucratic practices. Fifth, although the operational characters of non-statutory planning tools cannot be standardized, they have universal features regarding the discriminatory operation of state and gemeinde, complementary role for statutory planning tools, legal basis, recommendations of the federal government for spatial policy guidelines, and self-binding effectiveness of the administration. Sixth, non-statutory planning tools become effective based on the collaborative consultative process among councils, citizens, professionals, local organizations in administrative support. Hence, designing an appropriate procedure that enables stakeholders such as local councils and citizens to participate in the planning process is important as a premise of the non-statutory planning process. This study intends to suggest legal logic for reorganizing the Korean spatial planning system and implications for the introduction of non-statutory planning tools. Korea needs to structure the legal logic of spatial planning system reorganization regarding the substantive transfer of participatory control rights based on the definition of planning autonomy and the upward distribution of powers through participation by local councils and residents. To respond to the new role and flexible operation of the spatial planning system, it was suggested that non-statutory planning tools can establish the operational direction to complement the statutory plan.
