In light of the rise in child abuse, the government recently strengthened the role and function of judicial police officer in initial measures for child abuse cases through the revision of the 「Child Welfare Act」 and 「Act on Special Cases Concerning the Punishment, etc. of Child Abuse Crimes」 to strengthen the role and function of judicial police officer in initial measures of child abuse cases. This is supplemented by the criticism that police intervention has not been active as child abuse crimes have been approached from a social welfare perspective, and that initial measures have been difficult in the event of child abuse crimes due to insufficient laws. Since August 19, 2021, the government is also working on supplementing the Child Abuse Response System, while strengthening the anti abuse police officer system to effectively function in preventing child abuse and handling child abuse cases.
This paper examines the role and the status of the police in child abuse cases and the Anti Abuse Police Officer System, focusing on the current legislation regarding child abuse, and suggested improvement measures that would enable early intervention and effective initial action by the police. As for its contents, this paper insists on strengthening the role of judicial police officer refining the Anti Abuse Police Officer System. In particular, this paper emphasizes that child abuse cases and child abuse crime cases should be clearly distinguished, thereby clarifying the roles and the intervention of abuse prevention police officers, judicial police officers and officials in charge of child abuse. At the same time, by establishing a smooth cooperation system, child abuse (crime) cases would be reasonably dealt with.

아동학대가 심각해짐에 따라 정부는 최근 「아동복지법」과 「아동학대범죄의 처벌 등에 관한 특례법」의 개정을 통해 아동학대사건의 초동조치에 있어서 사법경찰 관리의 역할과 기능을 강화하였다. 이것은 그동안 아동학대범죄를 사회복지적 관점에서 접근함에 따라 경찰의 개입이 적극적이지 못하였고, 관련 법률의 미비로 인하여 아동학대범죄사건이 발생한 경우에 초동조치에 어려움이 있었다는 지적에 따라 이를 보완한 것이다. 한편, 정부에서도 심각한 아동학대사건이 빈발하고 있는 것을 고려하여 2021년 8월 19일 ‘아동학대 대응체계 보완방안’을 마련하여 추진 중이다. 이와 병행하여 경찰에서도 아동학대에 대한 대응방안을 강구하는 한편, 학대예방경찰관제도를 강화함으로써 아동학대의 예방 및 아동학대사건의 처리에 있어서 학대예방경찰관이 실효적으로 기능하도록 노력하고 있다.
이에 본고에서는 아동학대 관련 법제를 중심으로 하여 아동학대에 있어서 경찰의 역할과 실태 및 학대예방경찰관제도에 대하여 살펴본 후, 아동학대사건이 발생한 경우에 경찰의 조기개입과 효과적인 초동조치를 가능하게 하기 위한 개선방안을 제시하였다. 그 내용으로는 아동학대범죄사건에 있어서 사법경찰관리의 역할 강화 및 학대예방경찰제도의 개선을 주장하였다. 특히, 아동학대사건과 아동학대범죄사건을 명확히 구분하여 개별사건에 있어서 학대예방경찰관과 사법경찰관리, 학대예방경찰관 또는 사법경찰관리와 아동학대전담공무원의 역할과 개입의 범위와 한계를 명확히 함과 동시에 상호 간에 원활한 협력체계(원스톱시스템)를 구축함으로써 아동학대(범죄)사건을 합리적으로 처리할 것을 강조하였다.
