In this study, precedents and cases of authoritative interpretation of Article 17 of the Local Finance Act were thoroughly investigated and reviewed. As a result of the review, Article 17 of the Local Finance Act exceptionally permits public expenditures to individuals, corporations, and organizations, and local governments must carry out projects in accordance with the purpose of the article.
The quality of local subsidy management should be improved by improving the operation method of the local subsidy management committee. First, the effectiveness of the local subsidy management committee must be secured. Considering the purpose of the introduction of the local subsidy management committee system, such as the need for a strong internal control mechanism to prevent the illegal use of local subsidies, a plan to grant the status of the head of a local government as a decision-making body to be bound by the deliberation opinion of the committee is reviewed.
Second, the independence of the local subsidy management committee must be secured. Considering that the tenure of the head of a local government is four years, in order to block the influence of the appointing authority in the first place, it is necessary to make the tenure of the private members of the local subsidy management committee longer than the tenure of the head of the local government, or at least the same.
Third, the expertise of the local subsidy management committee must be secured. In order to enhance the professionalism of the committee"s decision, it is necessary to review a plan to specify in the law a specialized agency that supports the local subsidy management committee to make objective and rational decisions on matters under its jurisdiction.
Fourth, it is necessary to secure the fairness of the local subsidy management committee. It is necessary to separately prepare strong sanctions against those who violate the rules for exclusion, avoidance, and avoidance of local subsidy management committee members (Article 26, Paragraphs 7 to 9 of the Local Government Subsidy Management Act). In addition, it is necessary to stipulate in more detail the standards and procedures for the composition of local subsidy management committee members.
