In general, the self-employed (or self-employed workers) in most European countries enjoy freedom of association, while less the case for the right to collective bargaining. The presence and application of EU competition law is considered to be its root cause. The 2014 FNV Kunsten ruling by the EU Court of Justice in particular has clarified that the right to collective bargaining is not to be granted to the self-employed unless they are deemed "self-employed" in name only. It is noteworthy, however, that dependent self-employed workers tend to be treated in grey zones and each State in Europe retains and exercises certain regulatory discretion in conferring collective bargaining rights. In September 2022, the European Commission introduced a guideline to address this matter of a conflict of two different sets of norms, namely labour law and competition law, which is to be complied with by EU competition law enforcement. Another European Inter-governmental organisation, the Council of Europe, appears to take a similar approach to this legal issue. The European Committee of Social Rights considered in a case concerned with an Irish statute of competition law that “false self-employed workers” or “fully dependent self-employed workers” under the statute should be able to exercise their right to collective bargaining. These European cases cannot be used as a direct basis for interpretation of our own labour law statutes. Nevertheless, Korea has also put forth comparable efforts in expanding the personal scope of collective labour law for the dependent self-employed. The recent European approaches will thus be referred to as a guideline in dealing with the problems currently facing Korean society.
