This paper has attempted to understand globalization in light of legal theory by taking the ISDS as a striking example in the area of economics. This paper examines a variety of globalization theories by analyzing representative cases to explore the theoretical dilemmas between contradicting tendencies such as traditional and new theories, national and global issues, etc. In doing so, this paper will focus on globalization in the economic arena with a particular emphasis on Investor-State Disputes Settlements(ISDS).
This paper commences with an exploration of ISDS in the economic arena. Toward this goal, the paper analyzes the peculiar trends of globalization as sectorial differentiation and regional integration. In globalization, contradictions exist between the national economic order(NEO) and the global economic order(GEO) that lead to controversial issues surrounding the ISDS regime. Many worry that investors under the ISDS might meddle into national regimes which are legitimated by sovereign wills at the domestic level.
Against this backdrop, this paper maps out a variety of globalization theories to explain the ISDS: New Constitutionalism, Transnational Constitutional Pluralism or Legal Pluralist Constitutionalism, Global Administrative Law Theory. By examining these theories, the paper proposes public law approach as a plausible alternative which insists that the global economy, in a practical sense, relies on state-centered public law frameworks. Given public/private distinctions and classical sovereignty, ISDS under FTA should be construed as a kind of public law system of adjudication distinct from commercial arbitration and inter-state adjudication.
However, this approach should, in the philosophical and historical contexts, require a more elaborate distinction between the public law frameworks and the state-centered frameworks, at the face of prevailing belief that identifies the public with 'the of-state(what is related to the state or what is of the state).' Such a belief is a formalistic understanding that could throw the autonomous global arena into bureaucratism without any consultation with the public because it ignores the fact that the concept of the public has been developed differently than the state. On the contrary, a substantial understanding of the concept of the public serves as a logical linking between the state-centered (international) regimes and the global landscape. Further-more, this study suggests that globalization can be considered in the context of the global public sphere through embracing sovereign state frameworks and non-state frameworks. Through adopting this perspective, this paper proposes to explore the global public sphere based on cooperative relationships between non-state public actors and the state. In this context, this study insists that one should view the ISDS as a player in the global public regime which should be embodied in principles of the public such as participation and openness. According to these principles and the understanding of globalization, this paper provides a general reform direction through suggesting a mutual deference system that incorporates the pursuit of participation and openness in its procedures.
