This paper aims to review legal problems to be considered regarding the legislating of administration department in schools, which is currently under discussion in Korea.
Schools are regarded as a community that is comprised of school teachers, administrative personnel, students and students' parents, etc. As a result, there are a variety of conflict of interest between those members. The studies on the relationship and conflict between school teachers and administrative pesonnel have been mainly done from the perspective of pedagogy or public administration, whereas the studies from the lawful perspective have not been sufficiently made yet.
Currently, school teachers and administrative pesonnel in schools are in bitter conflict over the controversial issues regarding the legislating of administration department in schools. However, it is not simply a problem between school teachers and adminstrative personnel in schools, but it is also a problem involving the entire members comprising the whole school community, the local government and educational administrative agency, as well as the nation.
In the conclusion, the legislating of administration department in schools is not just a matter of dissolving the conflict of interest between school teachers and administrative personnel, but a problem that should be solved through comprehensive consideration of the legal resevation(Gesetzesvorbehalt) and principles of administrative organization, the local autonomy and educational autonomy, and the eudcational and learning rights.
