Contrary to expectations that the new administration in Korea would drastically transform the country’s policy on the clarification of the past, there has been little change in the existing mechanism and basic tone of related activities for many reasons. The thorniest issue regarding settlement of the past is mass deaths of civilians during the period from liberation of the country from Japanese colonial rule to the Korean War. This study delves into the differences between and unique characteristics of laws and institutional schemes formulated to reveal the truth of such cases, and touches upon the controversies concerning their implementation, focusing on the purposes and goals of such laws, fact-finding decisions and authority, follow-up actions, and potential issues for the future.
The four acts enacted to accommodate fact-finding efforts and changes in governance and to reflect political interests shed new light on mass deaths in an institutional respect. This simultaneously resulted in institutional imbalance and created multi-layered goals concerning the efforts to discover the truth of similar incidents, affecting the objectives and details of such efforts. Most fact-finding efforts, which entail investigations, reconstruction of incidents, and decision-making, were based on witness remarks and interviews due to lack and unavailability of necessary materials. It has been confirmed that the findings have lower-than-expected credibility.
The credibility of findings depends on the relationships between the state, press, and victims, and the level of acceptance of them. The task to be tackled after discovery of the truth is to seek social acceptance and necessary changes. Progress in this task seems far below our expectations, which implies that substantive headway will be made only when critical thinking is applied to the truth surrounding mass deaths of civilians under a fundamental goal, thereby healing the wounds that were inflicted.
