In the past, the Korean public employees did not have the right to engage in union activities. Article 33(2) of the Constitution states that "only those government employees, who are designated by statute, shall have the right to organize, bargain collectively, and engage in concerted activities." In accordance with the Constitution, Article 66(1) of the National Public Service Law provides that government employees, except those covered by any other law, shall not engage in collective activities such as unions. Consequently, the unions established in the Postal Office, Railroad Office and National Hospital are allowed to engaged in union activities. Also, teachers union is given the right to organize the union, bargain collectively.
Thus, Korea appears to on the verge of providing the union right to the public sector labor unions. Since no legal doctrine has been developed to help establish the pubic sector labor laws, this thesis is to examine the appropriate model suitable for the Korean situation. The first part will discuss the 1genera legal doctrine which explains the reasoning how the union rights of public sector union may be restricted. Second part will examine the special legal doctrine governing the various individual parts of public sector labor. They include the teacher, government officials, public corporations, and government owned corporations. The emphasis will be placed on the scope of collective bargaining and impasse procedures as an alternative to a strike model.
