There are several problems in the use of terminology, Mediation and Intercession as ADR in Korea. So the problems must be removed and improved immediately. And the Korean Commercial Arbitration Board have to play an important role in this point.
First, the use of terminology of mediation is very confused with the use of intercession and conciliation in Korea. Therefore the definition and translation of mediation must be arranged and unified in Korea.
Second, In order to arrange and unify the definition and the translation of terminology of mediation, we had better establish the Definition Committee in the Korean Commercial Arbitration Board with Korea Arbitrators Association and Korea Bar Association to define and unify the terminology of ADR.
Third, the Korean Commercial Arbitration Board had better review the use of terminology of ADR in publication of the KCAB, also the KCAB unify and correct the mistake of the use of ADR terminology.
Fourth, we had better unify the use of the terminology of Chinese character in the field ADR in Korea, China, Taiwan, Japan to develop ADR in those countries.
Fifth, the Korean Commercial Arbitration Board strives to arrange or amend the rules relating to intermediation of the KCAB for the reliable lawful power.
Sixth, the Korean Commercial Arbitration Board had better establish a Intermediation and Conciliation Center to develop Conciliation System as ADR in our variety society. Furthermore the KCAB had better strengthen research system to research ADR in that institution.
