This article studies recent changes in short sale regulation mainly triggered by the recent Global Financial Crisis, particularly focused on the regulation of the United States. The US has adopted Regulation SHO in 2004 in which the long standing up-tick rule was abolished and the current regulatory framework has been set. This paper gives detailed explanations about each rule of the Regulation. In addition, the study reviews urgent measures regarding to the short sale regulation since the second half of the year 2008.
There have been some important changes in short sale regulation in Korea too. The newly enacted Financial Investment Services and Capital Markets Act directly stipulates short ??sale regulation that had been primarily dealt with by a rule of the Korea Exchange.
The article explains the framework of short sale regulation in the Act and some delegated regulation in the Korea Exchange’s relevant rule in detail. Finally it makes some suggestions for better short sale regulation.
