The purpose of this study aims to analyse the prima facie evidence of the B/L and electronic B/L in the international trade transaction with International Rules, especially Rotterdam Rules. Not every statement in the bill of lading will trigger the estoppel. Some matters are plainly not within the scope of the judgement of the master or other person signing the bill of lading. Statements in the bill of lading as to quantity loaded will still amount to prima facie evidence of the facts thereby stated. Therefore, if the shipowner can adduce evidence that a lesser quantity was loaded than that stated on the bill of lading, this will enable it successfully to defend an action for short loading brought against it by the buyer.
Electronic means of communication are already widely used in the industry for the transmission of various types of information, ranging from vessel manifests to bill of lading data. 111e question is whether such facilities could be used for the development of electronic alternatives to the traditional paper documents. More hope may be derived from the current draft of CMI/UNCITRL proposal for a carriage regime designed to supersede the Hague and Hague-Visby Rules. These proposals seek to establish a general principle of equivalence between electronic and paper communications subject only to the proviso that the use of an electronic bill must have the express or implied consent of the carrier and shipper involved.
