UNCITRAL has launched a project for new transportation convention 2002 and a diplomatic conference for this convention will be held in October 2008. Under this new draft convention, transport documents are one of very important and essential part. It include not only the traditional negotiable bill of lading but also newly invented seaway bill.
The new draft convention adopts the same system as Hague-Visby rule in relation to the evidentiary effect of traditional bill of lading. However, it expands the effect to the straight bill of lading and seaway bill. The conclusive evidence is allowed to the innocent third party against the carrier provided that it indicate that the document should be surrendered in order to take delivery of the goods even in the non-negotiable document. This provision aims at the unification among the countries on the effect of the straight bill of lading. Taking the CMI model law into consideration, representatives from the countries for the draft convention decided to allow the prima facie evidence to the seaway bill and even the conclusive evidence on the information provided by the carrier himself.
The draft convention also tries to solve several other recurring problems in the maritime transportation such as pre-paid freight, unknown clause and identity of carrier. These three issues are derivative issues from the evidentiary effect of the transport document.
The writers explain the new development of the UNCITRAL transport law project in details, while focusing on the effect of transport document, comparing with the provisions of Korean Commercial Code and Hague-Visby rules.
