Using network analysis, this paper attempted to identify the core regulations in medical service to suggest the priorities of regulatory reform. A regulation with high degree centrality has many direct links with other regulations and more impact on them. Meanwhile, a regulation with high ‘between centrality’ has high frequency to link with other regulations in bundled regulation. The study shows that (1) three regulations among the five highest regulations with high degree and between centrality correspond each other. This implies that the medical service regulations have some core regulations within bundled regulations. (2) The regulations with high degree and between centrality are occupational licensing for supplying medical services. (3) The regulations with high degree centrality are standard regulations of medical institution. (4) The regulations with high between centrality are mainly administrative regulations. The results suggest the priorities of regulatory reform in the medical service such as the lives and safety of the people, and public health
service: (1) ‘Medical Service Act No. 27’, (2) ‘Welfare of the Aged Act No. 22’, (3) ‘Enforcement Regulations of the Medical Service Act No. 27".

이 논문은 2016년 3월 현재 규제정보포털에 등록된 411건의 의료서비스 관련 규제를 대상으로 네트워크분석을 활용하여 의료서비스 분야의 덩어리 규제와 핵심(core)규제를 식별하고, 이를 바탕으로 개혁의 우선순위를 제시하기 위한 시론적 연구이다. 연결중심성이 높은 규제는 덩어리 규제 내에서도 직접적인 연결 관계가 많아 다른 규제들에 미치는 영향력이 큰 규제이고, 매개중심성이 높은 규제는 두 개의 다른 규제가 관계를 맺기 위해 거쳐야 하는 빈도가 높은 규제로서 덩어리 규제를 분리하기에 용이하다. 분석결과, 연결중심성과 매개중심성이 높은 상위 다섯 개 규제 가운데 세 개가 서로 일치하였는데, 이 규제들은 의료서비스 제공자의 자격기준을 명시한 직업면허 규제인 것으로 나타났다. 상위 다섯 개 규제들 가운데 연결중심성만 높은 두 개의 규제는 의료기관 시설 기준을 규정한 투입요소기준규제이며, 매개중심성만 높은 두 개의 규제는 규제대상이 준수해야 할 행정절차를 규정한 행정적 규제이다. 의료서비스 분야의 규제는 몇 개의 규제를 중심으로 덩어리 규제가 형성되어 있음을 알 수 있다. 분석결과를 바탕으로 의료서비스가 국민의 생명과 건강, 공공성과 관련이 있다는 점을 고려하여 직업면허를 통한 의료관광 활성화와 선
진의료기술의 도입을 저해하는 ‘의료법 27조’, 투입요소기준규제로 인해 규제대상의 자유로운 의료기관 경영을 제약하는 ‘노인복지법 22조’, 복잡한 행정적 규제로 의료기관 개설 시 규제대상의 부담을 가중시키는 ‘의료법 시행규칙 27조’를 규제개혁 대상으로 선정하였다.
