Korea, which has entered into the multicultural society, has put lots of continuous efforts to improve institutional and legal basis for multicultural society. This has helped a lot, however, the we still have lots of improvement points. In legal aspects, the definition of multicultural society does not exist in the current legislation. But we could define it as a society acknowledging member of multicultural society, guaranteeing the equal legal status among cultures and respecting or protecting minority in our society. The approach of legitimizing multiculturalism in Korea would be ‘cultural approach’ as well as ‘politics of difference approach’ and ‘formation of identity approach’.
Current law on the multicultural society would be divided into laws on the broad multiculturalism on the process of development (law on the protection and improvement of the cultural diversity, the Displaced Persons Act), laws on the narrow multiculturalism on the process of development (Multicultural Families Support Act, Act on the Treatment of Foreigners in Korea) and law on the limitation of member of multicultural society (Immigration Control Act, Nationality Act, the act on the employment of foreign workers, Family law on ｢civil law｣). When seeing the trend of legislation on the multicultural society, Korea’s multicultural policies is focusing on the process of the multiculturalism. To take this point into consideration, each law on the multicultural society should be revised to take each law’s purpose into the consideration within keeping legal stability of our society.

현재 다문화사회에 속해 있는 우리나라는 다문화사회 속에서 많은 제도적 법률적 개선을 위한 노력을 지속하고 있으며, 이로 인하여 문제의 개선이 되는 부분도 있지만, 여전히 법률적으로 개선을 하여야 할 부분도 존재한다. 법률적 측면에서 다문화사회와 관련한 정의규정은 현행 법률에는 존재하지 않는다. 다만, 우리나라의 다문화사회는 다문화사회를 구성하는 각 문화주체의 정체성을 인정하고 각 문화주체간의 평등한 법적 지위를 보장하며, 동시에 정식으로 소수자인 문화적 약자를 존중하고, 보호하고, 배려함으로서 상호 공존하는 사회로 정의할 수 있을 것이다. 우리나라에서의 다문화주의의 실천을 정당화 하는 접근방식은 『문화적 접근방법』을 중심하여 『차이의 정치 접근방식』이나 『정체성 형성 접근방식』도 같이 포섭하여 전개해 나갈 필요가 있다.
현행 다문화사회 관련 법률은 크게 발전과정 중의 광의의 다문화주의 관련 법률(문화다양성의 보호와 증진에 관한 법률, 난민법), 발전과정 중의 협의의 다문화주의 관련 법률(다문화 가족지원법, 재한외국인 처우 기본법), 다문화사회 구성원에 대한 제한 관련 법률(출입국관리법, 국적법, 외국인근로자의 고용 등에 관한 법률, 『민법』 중 가족법)로 구분할 수 있다. 현재 우리나라 다문화사회와 관련한 법률의 입법동향 등을 보았을 때 우리나라 다문화정책은 발전과정 중의 다문화주의에 중점을 두고 있다. 이러한 점을 고려하여 우리 사회의 법적 안정성을 지킬 수 있는 범위 내에서 다문화사회 관련 법률 등에 대한 부분에 있어서는 각각의 개별 법률의 입법 목적을 고려하여 법률 개정 등이 이루어질 필요가 있다.
