Employee's rights are provided by the Constitution, especially section 32 and section 33, on which employment relations law and labor relations law are based respectively. In th light of the framework of civil rights under the Constitution, the employee's rights could have legal characters as both the liberty and the social rights. But it is important that employee's rights may have another character compared to common civil rights. It is the character of the legal institution guaranteed by the Constitution. Employee's rights could be on not only liberty and social rights but also collective and voluntary system for settlement of interests as a kind of collective autonomy under the Constitution. The concept of collective autonomy is resulted from the principle of private autonomy and is intended to actualize the principle. The collective autonomy is founded on the equality rule and the opposability rule. The equality rule is concerned with the equality between labor and management on a general and abstract level. Then, the opposability rule means that employee's associations should be independently maintained against employer's inference and a third party's intervention out of labor relations. At present, the economic climate surrounding labor relations is rapidly changed and it require us to flexibly expand such collective autonomy concept for including new type of the system of self- government in workplace. If the collective autonomy is interpreted as something more than the autonomy of collective agreement, the labor association can be extended to the concept more than labor union and the right to bargain collectively can have meanings more than ‘collective bargaining to conclude the collective agreement.’
