공공기여금은 지방자치단체가 지구단위계획수립·변경에 의한 사전협상을 통해 용적률상승 또는 건축제한 완화에 따른 개발이익을 환수하여 지구단위계획내지역이나 기반시설취약지역에 기반시설부지를 제공하거나 기반시설의 설치 및 그 설치비용을 부담케 하는 금전급부제도이다. 국토계획법 및 동법시행령, 서울특별시 도시계획조례 등에서 공공기여금의 재정배분에 관한 근거가 마련되지 아니하여 서울 강남구 소재 한국전력공사가 전남 나주로 이전함에 따른 한전부지개발의 공공기여금 배분이 지방자치단체간의 갈등과 법적 분쟁이 심화되고 있다. 그러함에도 불구하고 공공기여금의 법적성질 및 공공기여금의 법적문제에 관하여 전혀 논의 되어지지 않고 있는 실정이다. 공공기여금에 관한 선행연구는 소규모 개발부지에 대하여는 개발부담금, 대규모개발지는 기부채납으로 부과하는 방안과, 공공기여의 개념, 기반시설 범위확대, 기반시설 설치비용 법적근거 마련이 논의되었다. 따라서 이하에서는 공공기여금의 개념을 정의한 후 공공기여금의 법적 성질을 규명하고, 현행법상의 사전협상제도와 공공기여금제도, 공공기여금 배분의 필요성을 논의한다. 또한 공공기여금의 법적 명확성 확보, 지방자치단체의 조례에 의한 공공기여금제도 신설과 운영, 공공기여금의 한계와 합리적 배분, 공공기여금 재정배분시 사전협상제도 활용, 공공기여금의 기반시설 설치기금조성, 공공기여금배분의 주민참여 강화 등의 법적 문제를 검토하여 그 개선방안을 모색한다.
