The pre-negotiation system is a system that contributes to urban development by returning profits by upzoning or rezoning during the process of urban planning change and development according to appropriate and reasonable standards while inducing development for urban revitalization. Prior to the introduction of the pre-negotiation system, public contributions in various ways were implemented for each project, such as donation acceptance following changes in urban and county management plans and donation acceptance in urban renewal projects.

The pre-negotiation system was first introduced by the city of Seoul in 2009, and as of January 2023, 13 special and metropolitan cities and local governments nationwide are operating the pre-negotiation system. Recently, cases of public contribution restitution are increasing in cities and counties in Gyeonggi-do, but public contributions are being carried out according to individual cases rather than using the pre-negotiation system.

In this study, issues and alternatives in operating the pre-negotiation system were presented to establish a direction for efficient system establishment. The first issue is that after the introduction of the pre-negotiation system, the upper statute was revised to establish a legal basis, but there is a controversy over interpretation in actually applying the statute. In determining the subject of pre-negotiation and the underlying laws, the subject of pre-negotiation should not be pre-determined or limited, and both major stronghold areas and general areas should be included in the candidate sites. Then, it is proposed to be selected through the review of the executive department and the consultation of the committee.

The second issue is the pre-negotiation system public contribution rate. Currently, local governments operating the pre-negotiation system improve and apply the ratio of land value of the increasing floor area ratio, but in reality, there is a difference in the return rate depending on the degree of land price increase. The pre-negotiation standard for public contribution rate is proposed to be set within the range of increase in land value after appraisal, considering regional conditions. In addition, a low level of public contribution is applied to induce development in underdeveloped areas, and a high level of public contribution is applied to suppress development in high-density development areas.

The third issue is that public and infrastructure facilities, which are essential for the project, should not be included in public contributions when installing public facilities and infrastructure within the project site, which causes a difference of opinion between the public and private sectors. Public contribution facilities include public facilities and infrastructure under the National Land Planning and Utilization Act, but facilities that fall under essential infrastructure are excluded.
